Hudson Valley Luxury Resorts — Property Listing Agreement
Effective Date: Upon submission of your property listing through the Hudson Valley Luxury Resorts Host Dashboard.
By submitting a property listing through Hudson Valley Luxury Resorts (“HVLR,” “we,” “our”), you (“Owner,” “Host,” “you”) agree to the following terms governing the listing, marketing, and management of your property on our platform.
1. Listing Submission and Approval
All property submissions are subject to review and approval by the HVLR team. Submission of a listing does not guarantee acceptance into the HVLR portfolio. We reserve the right to decline any property that does not meet our quality standards, and we are not obligated to provide reasons for declining a submission.
Approved listings may be edited by our team for clarity, consistency, search engine optimization, and alignment with HVLR brand standards prior to publication. You will be notified when your listing goes live.
2. Listing Fee and Design Setup
An active listing on Hudson Valley Luxury Resorts requires a monthly membership fee as displayed on the membership selection page at the time of purchase. This fee covers your property’s placement on the HVLR website, inclusion in our marketing channels, and access to our host dashboard tools.
In addition to the monthly membership fee, a one-time listing design and setup fee is charged with your initial membership purchase. This fee covers professional property page construction, SEO optimization, photo curation, booking system integration, and inclusion in HVLR’s marketing channels. The design fee is non-refundable.
The monthly listing fee is non-refundable for the current billing period. If your membership is not renewed, your listing will be removed from active display at the end of the current billing cycle.
3. Minimum Commitment Period
Your listing membership requires a minimum commitment of six (6) consecutive months from the date of your initial membership purchase. During this commitment period, you agree to maintain an active membership and may not cancel or request a refund of monthly fees. After the six-month commitment period has been fulfilled, you may cancel your membership at any time, effective at the end of your current billing cycle.
If you cancel before the end of the six-month commitment period, you remain responsible for the remaining monthly fees through the end of the commitment period.
4. Property Information Accuracy
You represent and warrant that all information provided in your listing submission is accurate, complete, and not misleading. This includes but is not limited to property address, guest capacity, bedroom and bathroom count, amenity descriptions, and pricing.
You agree to promptly update your listing through the Host Dashboard if any material information changes, including pricing adjustments, amenity changes, availability restrictions, or property condition changes.
5. Photography and Media
By uploading photographs and media to your listing, you grant HVLR a non-exclusive, royalty-free license to use, display, reproduce, and distribute these images across our website, social media channels, partner booking platforms, and marketing materials for the purpose of promoting your property and the HVLR brand.
You represent that you own the rights to all uploaded media or have obtained the necessary permissions from the copyright holder. HVLR is not responsible for any copyright claims arising from media uploaded by the Owner.
HVLR may arrange professional photography of your property at our discretion. Photographs taken by or commissioned by HVLR remain the property of HVLR and may continue to be used in our marketing materials even after your listing is removed.
6. Content Editing and Optimization
You acknowledge and agree that HVLR may edit, rewrite, or optimize your property title, description, and listing content for search engine performance, brand consistency, and guest experience. The factual accuracy of your property details (capacity, amenities, location) will be preserved in any edits.
If you make changes to a published listing through the Host Dashboard, those changes will be placed in a review queue and will not appear on the live site until approved by our team.
7. Booking and Guest Management
HVLR facilitates guest inquiries, booking coordination, and marketing for your property. Actual booking transactions, payment processing, and reservation management are handled through our property management systems and partner platforms.
You agree to maintain your property in the condition represented in your listing, honor confirmed reservations, and provide a guest experience consistent with HVLR’s quality standards.
8. Property Standards
Properties listed on HVLR are expected to maintain a standard of quality consistent with the luxury vacation rental market. This includes but is not limited to cleanliness, maintenance, functional amenities, adequate furnishings, and responsiveness to guest needs.
HVLR reserves the right to suspend or remove any listing that receives consistent negative guest feedback, fails to meet our quality standards after a review, or misrepresents the property’s condition or amenities.
9. Cancellation and Removal
Subject to the minimum commitment period described in Section 3, you may cancel your listing after fulfilling the six-month commitment by discontinuing your membership renewal. Your listing will remain active through the end of your current paid billing period and will be removed from the site upon expiration.
HVLR reserves the right to remove any listing at any time for violation of these terms, quality concerns, legal compliance, or at our sole discretion. In the event of removal initiated by HVLR for cause, no refund of the current billing period will be issued.
10. Limitation of Liability
HVLR acts as a marketing and booking coordination platform. We are not a party to any rental agreement between you and your guests. HVLR is not liable for property damage, guest injuries, booking disputes, or any claims arising from the rental of your property.
You are responsible for maintaining appropriate insurance coverage for your property, including liability insurance adequate for short-term rental operations.
11. Indemnification
You agree to indemnify and hold harmless Hudson Valley Luxury Resorts, its owners, employees, and agents from any claims, damages, liabilities, or expenses arising from your property listing, the rental of your property, or your breach of these terms.
12. Modifications to Terms
HVLR reserves the right to modify these terms at any time. Updated terms will be posted on this page with a revised effective date. Your continued use of the Host Dashboard and maintenance of an active listing constitutes acceptance of any modified terms.
13. Governing Law
This agreement is governed by the laws of the State of New York. Any disputes arising from this agreement shall be resolved in the courts of Westchester County, New York.
