Mobile Text Messaging (SMS) Program

Hudson Valley Luxury Resorts operates an opt-in text-messaging program (“SMS Program”) used to send booking updates, availability alerts, customer-service replies, and — where separately consented — promotional offers. This section describes how we collect, use, share, and retain the personal information associated with that program. Operational details for participants, including opt-in and opt-out instructions, are set out in Section 13 of our Terms of Service.

Information We Collect Through the SMS Program

When you opt into the SMS Program, we collect:

  • The mobile telephone number you provide;
  • The date and time of your opt-in;
  • The IP address of the device you used to opt in;
  • The consent source — the specific form or channel through which you provided consent (for example, our booking form, contact form, or account-registration form);
  • The content of messages you send to us and that we send to you in connection with the program.

How We Use This Information

We use the information collected through the SMS Program to:

  • Send transactional messages, including booking confirmations, check-in instructions, and service updates;
  • Send marketing messages — such as promotional offers and availability alerts — only where you have separately consented to receive them;
  • Respond to customer-service inquiries you send by text;
  • Maintain records of your consent and opt-out requests as required by applicable law.

SMS messages are delivered on our behalf by Text Magic, acting as our service provider, and transmitted by your mobile carrier.

Who We Share This Information With

We share information collected through the SMS Program only as needed to operate the program and meet our legal obligations:

  • Text Magic — our SMS-messaging service provider — processes your mobile number and message content solely to deliver messages on our behalf and in accordance with its own privacy practices;
  • Mobile carriers — including AT&T, T-Mobile, Verizon Wireless, and others — route messages to and from your device;
  • Legal and regulatory authorities, where we are required to disclose information to comply with applicable law, a court order, or a valid governmental request.

We do not sell your mobile number or share it with third parties or affiliates for their own marketing purposes. Mobile opt-in data and consent records are not shared for marketing by any party other than HVLR.

How Long We Keep This Information

We keep the information collected through the SMS Program for as long as you remain opted in, plus a reasonable period afterward for compliance and recordkeeping. In most cases, we retain consent records for approximately four (4) years after opt-out so that we can evidence prior consent if required by carriers, regulators, or in the event of a dispute. Longer retention may apply where required by law.

Your Rights and Choices

You have the following rights in connection with the SMS Program:

  • Opt out at any time by replying STOP to any message you receive from HVLR. You will receive one final confirmation message, after which no further messages will be sent to your number;
  • Get help by replying HELP to any message, or by contacting us at (845) 510-3188 or contact@hudsonvalleyluxuryresorts.com;
  • Request access to your consent records or ask us to delete information associated with your participation in the SMS Program, subject to any recordkeeping requirements described above;
  • Update the number on file by contacting us through the channels above.

Exercising these rights will not affect other services you receive from HVLR.

Cross-Reference

For the full operational terms of the SMS Program — including program description, message frequency, supported carriers, age requirements, and carrier disclaimers — please review Section 13 of our Terms of Service.
